Bill Provisions
Unless driving is an essential job function or related to a legitimate business purpose for a position, unlawful for employer to require a valid driver's license for employment.
It is also unlawful for job posting to say an applicant must have a valid driver's license.
Director must investigate complaints regarding compliance; director may require the testimony of witnesses and production of documents as part of an investigation.
If director determines violation occurred, may issue citation and notice of assessment, order employer to pay to complainant actual damages, or $5k, whichever is greater.
Wages and interest owed must be calculated from 4 years from the last violation.
