On Sep. 17, TX LEG approved bill to prohibit making of abortion drugs.
TX LEG approved Bill HB 7 re prohibitions on manufacture and provision of abortion-inducing drugs, jurisdiction by courts in and outside TX, authorizing qui tam actions.
Bill amends Subtitle H, Title 2, Texas Health and safety code, by adding a new Chapter 171A (TX LEG 2-H-171A.001 to 171A.151) regarding abortion-inducing drugs.
Legislative Provisions
Incorporates relevant definitions, prohibits the manufacture or distribution of abortion-inducing drugs, as well as the mailing, transporting or prescribing them in State of TX.
Does not prohibit speech or conduct protected by the First Amendment to Constitution.
Also does not prohibit conduct a pregnant woman takes in the course of aborting or attempting to abort the woman’s unborn child, or use of the drugs in 171A.002(a)(9).
The subchapter may be enforced only through a qui tam action by a relator against a person who violates Chapter Section 171A.051 or intends to violate Section 171A.051.
Adds situations when qui tam may be enforced, exceptions and affirmative defenses.
Statute of limitations under Section 171A.101 is 6 years after date of cause of action.
If a qui tam relator prevails in an action, will be subject to injunctive relief, attorney fees and costs, and will be given an amount of not less than $100,000 per violation.
