Legislative Provisions
Insurance company, nonprofit health service corporation, health maintenance organization (HMO) may not deliver, issue, execute, renew any health benefit plan.
Unless plan provides benefits for insulin drug and medical supplies for insulin dosing.
Health benefit plan must limit out - of-pocket costs for 30-day supply of overed insulin drugs (not to exceed $25 per pharmacy), covered medical supplies for insulin dosing.
Plan may not allow pharmacy benefits manager (PBM), pharmacy, distributor to charge or require individual to pay for covered insulin in amount over out-of-pocket limits.
May not impose deductible, copayment, coinsurance, other cost-sharing to cause out-of-pocket costs for prescribed insulin or medical supplies to exceed out-of-pocket limit.
