  • Jun. 2025 Overview Of Changes
  • On Jun. 2, 2025, POL MAL GVT presented the most important changes in the procedure for issuing work permits for foreigners and in the obligations of employers.
  • Due to technical issues re the functionalities of the electronic register of contracts, the obligation to submit signed contracts with foreigners will apply from Aug. 1, 2025.

On Dec. 18, POL FO announced a package of four employment bills.

  • POL FO announced POL FSP council of ministers has adopted draft laws on foreigners.
  • Follows POL GVT May 2024 issued draft act on foreigners' access to market, #213229.
  • The four proposed new regulations concern, among others, the Act on foreigners and the Act on granting protection to foreigners on the Territory of the Republic of Poland.
  • Act on Foreigners
  • Draft act amending the act on foreigners and certain other acts - the bill adapts Polish law to EU regulations, this is particularly the case for the directive on conditions of entry and residence of third-country nationals for highly qualified employment.
  • In force on first day of the month following 14 days from Journal of Laws publication.
  • Granting Protection to Foreigners
  • Draft act amending the act on granting protection to foreigners in Poland - enhances border security to counter Belarus's exploitation of migration, carried out in coordination with Russia and criminal groups to facilitate movement of migrants to EU.
  • To achieve this, a temporary restriction on the right to submit asylum applications is introduced; new regs also establish additional criteria for revoking refugee status.
  • Enter into force on the day following their publication in the Journal of Laws.
  • Conditions for Admissibility
  • Draft act on the conditions for admissibility of entrusting work to foreigners in Poland.
  • The draft provides for regulations concerning the employment of foreigners in Poland.
  • The new solutions include higher penalties for illegally entrusting them with work.
  • Focus on streamlined procedures, reduced arrears in offices, fully digitize proceedings.
  • Enters into force on the first day of the month following 14 days of publication in the Journal of Laws; transitional provisions are also introduced, which will allow the IT system to be adapted to the new regulations within two years.
  • Irregularities in Visa System
  • Draft act on amending certain acts to eliminate irregularities in Visa system in Poland.
  • Identification of irregularities was described in the report of the Supreme Audit Office and in the White Book prepared by the inter-ministerial working group.
  • Solutions are in line with government's migration strategy for Poland for 2025-2030.
  • Enters into force on the first day of the month following 14 days from the date of publication in the Journal of Laws, but some provisions will enter into force at a later date in order to enable relevant entities to prepare for the introduction of changes.
  • Effectiveness
  • The proposed draft laws have various effective dates.
  • In Feb. 2025, POL FSP adopted act on conditions for admissibility, see #244805.
  • May 2025 Acts Published
  • On May 12, 2025, POL GVT published the Act of Mar. 20, 2025 on the conditions for the admissibility of entrusting work to foreigners in the territory of Poland.
  • POL GVT published the Act of Mar. 20, 2025 on the labor market and employment services, that applies to Polish citizens and the foreigners described in the Act.
  • POL GVT published the Act of Apr. 24, 2025 amending the Act on Foreigners and certain other acts, regarding residence and working permits for foreigners.
  • All acts enter into force on the first day of the month following the expiry of 14 days from the date of publication, on Jun. 1, 2025.
  • May 12, 2025 Act on Visa System Irregularities
  • On May 12, 2025, POL GVT published Act of Apr. 4, 2025 amending certain acts in order to eliminate irregularities in the visa system of the Republic of Poland.
  • The act sets out rules for issuing visas and granting temporary residence permits to students and workers from non-EU countries; majority of act in force on first day of the month following expiry of 14 days from the date of publication, on Jun. 1, 2025.
  • Except for articles 33 and 35–38, which are in force on day following publication, i.e. May 22, 2025; articles 1, 4, 5, 6(2), (3), (4)(b), (6), (8–16), 8, 10–19, 21, 23–30, 34, which are in force on Jul. 1, 2025; articles 7, 31, which are in force on Sep. 1, 2025.

  • May 27, 2025 Electronic Submission
  • On May 27, 2025, POL MAL GVT clarified art 8 sec. 2 of the Act of Mar. 20, 2025 on the conditions for the admissibility of entrusting work to foreigners on the territory of POL.
  • From Jun. 1, 2025, applications for work permits for foreigners should be submitted exclusively electronically via a specific website; other submissions won't be considered.
